Music Contract Red Flags: What to Check Before You Sign
by October 5, 2025A contract can shape your career for years. Before you sign a management, production, label, publishing, or distribution agreement, you should understand exactly what you are agreeing to. Here are common music contract red flags to watch for.
RMG Empire note: The business side decides who gets paid. Roots Music Group helps artists understand ownership, splits, and strategy as part of our artist development services.
1. Unclear Ownership Terms
Know who will own your masters and publishing, and for how long. Be very careful with language that transfers ownership “in perpetuity,” meaning forever.
2. Long Terms With No Exit
Check how long the deal lasts, how it can be extended, and how you can get out if things are not working. A contract without a reasonable exit path is a major risk.
3. Vague Obligations
A strong contract says what each side must do. If the other party promises marketing, distribution, or funding, those commitments should be written down clearly.
4. Confusing Recoupment
Many deals let the other party recover costs from your earnings before you are paid. Understand which expenses are recoupable and how accounting works.
5. Broad Rights to Other Income
Some agreements, often called 360 deals, take a share of touring, merch, publishing, brand deals, and more. Make sure you understand every income stream included.
6. No Audit Rights or Statements
You should receive regular royalty statements and have the right to review how your money is calculated.
7. Pressure to Sign Quickly
A legitimate partner will give you time to review the agreement and get legal advice. Pressure to sign immediately is a warning sign.
8. Upfront Fees for “Guaranteed” Results
Be careful with anyone who charges large fees and promises guaranteed streams, placements, or success. Pay for clear services, not promises.
